THE REPUGNANCY DOCTRINE AND CUSTOMARY LAW IN NIGERIA – A PROPOSAL FOR RESTATEMENT AND CODIFICATION

The purport of this paper is to examine the nature, and application of customary law in Nigerian (customary) courts, with a view to proposing a system of restatement and codification. The article is basically a retrospective analysis of customary law applications in the pre and post colonial legal systems of Nigeria. Be that as it may, the issues discussed are still relevant in today’s legal system, in so far as customary laws remain, to a large extent,
unwritten and subject to common law rules.
