The advent of the 1999 Constitution of the Federal Republic of Nigeria has once again re-opened the issue of whether a public servant could be involved in private business, outside his official duties as a public servant. This issue has assumed an added constitutional significance in view of the proceedings recently initiated against the incumbent Governor of Lagos State at the Code of Conduct Tribunal, for allegedly operating a private business while in office.
